the same cards should be given back to player unless anyone, including the dealer, saw them. If so then the whole hand should be re-dealt

If the cards are taken and put in the “muck” the hand is dead. There is no re-deal. If the player catches it in the act, he can stop the dealer and get the cards back but more than likely the hand is dead.

If the cards are beyond the “muck” line, or the player has taken too long in the dealers opinion, the dealer will take the cards and the players hand is mucked (thrown out). Also, if the player is not at the table and the next player preforms an action then the originals players cards are mucked.
